Elizabeth is a Legal Director in the Healthcare team. She specialises in complex and high value claims, including brain injury and spinal injury. 

She has vast experience in an array of both medical and dental multi-party negligence claims for insurers, NHS Trusts and medical defence organisations, and is particularly  known for her experience in dealing with issues of non delegable duty and vicarious liability, and advising on coverage. She frequently manages more novel claims involving the Equality Act and the Human Rights Act, and was recently successful at trial on one such claim. Elizabeth is also adept at dealing with claims against healthcare professionals working outside of the jurisdiction, advising on claims made against doctors resident in Europe, the Caribbean and the Middle East.

Clients praise Elizabeth for being a “forward thinker” who “handles cases exceptionally well” and “delivers outstanding results”. In view of her robust approach, claims against her clients are frequently discontinued. 

Elizabeth supervises junior lawyers within the team and is an experienced speaker on healthcare law who has been commended for providing “clear and practical advice that is easily understood by different audiences”.

Experience
  • Whetstone v Medical Protection Society Ltd [2014] EWHC 1024 (QB) - Elizabeth successfully defended a claim at trial made by a dentist against the MPS relating to the terms of the discretionary indemnity offered to him; this has since become the leading case in relation to this form of indemnity.
  • Involvement with a high profile group action in relation to the insertion of PIP breast implants. This matter includes lots of complex issues regarding liability, who are the responsible parties and their Insurance coverage position.
  • Involvement with an alleged defective hip replacement case, representing the doctor who fitted and recommended the use of this product.
  • Elizabeth has also dealt with claims arising out of other defective products such as a spinal brace and an oxygen concentrator.
  • Representing insurers in successfully declining cover for a high value Fatal Accidents Act 1976 claim which did not fall within the insurance policy.
  • Winning at trial when acting on behalf of a dentist who was accused of breaching the Equality Act 2010 for discriminating against a patient on the grounds of her race
