In the aviation sector, James has extensive experience representing airlines and their insurers in litigation arising from the carriage by air, with an emphasis on personal injury, cargo and baggage claims. He also advises on a range of aviation-specific regulatory and compliance issues, including licensing, ticketing, privacy requirements, competition law rules, general operations, and the application of the conventions governing the international carriage by air.

In the maritime and trade sectors, his clients include commodity trading companies, charterers, vessel owners, cargo interests, port authorities, logistics companies and marine insurers. He is experienced in matters in respect of cargo loss, damage caused by vessels, contractual disputes, ship arrests and enforcement proceedings. He also provides non-contentious advice to industry clients on contractual issues, competition law compliance and other regulatory matters.

James also acts for major local and overseas-based insurers in matters involving complex, high-value claims and multiple parties. He defends directors and companies, on insurers' instructions, in regulatory investigations and ASIC proceedings. James also advises on a range of non-contentious matters including policy wording and coverage issues, data protection requirements, and other regulatory and compliance concerns.

  • Aviation – Advising the airline and insurers in relation to Australian-based claims following the loss of Malaysia Airlines flights MH370 and MH17
  • Aviation – Advising the airline and insurers in relation to Australian-based claims following the loss of Germanwings flight 9525 in France
  • Aviation – Successfully defended a major international airline in response to charges issued by the European Commission into alleged cartel activity in the air freight industry
  • Insurance – On insurers' instructions, conducted the successful defence for the Chairman of Mariner Corporation in a test case maintained by ASIC in the Federal Court of Australia regarding alleged contraventions of the Corporations Act with respect to an off-market takeover bid
  • Shipping – Representing a multi-national commodity trading company in vessel arrest proceedings in connection with the insolvency of a major shipping line
  • Energy – Acting for a Houston-based oil major in respect of claims of more than USD 100 million in multiple legal proceedings before the Supreme Court of Victoria involving gas sale contracts
  • Offshore energy and shipping – Represented a Norwegian maritime offshore entity in multi-party litigation in the Supreme Court of Victoria concerning the construction of an Australian-based gas plant
  • Offshore energy and shipping – Advising an international conglomerate in the offshore oil and gas industry in arbitration proceedings in respect of a multi-million dollar contractual dispute concerning the supply of a support vessel
  • Resources and arbitration – Acted for an Australian mining corporation in complex arbitration proceedings in a dispute over a contract of affreightment
  • Aviation – Advising an Indian-based airline on all legal and regulatory aspects arising from its commencement of UK operations.
