Ndumiso focuses on marine casualty litigation, cargo claims, customs disputes and has experience in providing advice to clients in various sectors including marine insurance, supply chain, port operations, dangerous goods carriage, oil and renewables.

Ndumiso regularly advises the insurance and marine insurance market on general claims, cover disputes and subrogated recoveries.

Ndumiso's admiralty law experience extends to acting for ports, cargo owners and vessels, as well as their respective insurers in advancing and defending maritime claims falling within the Jurisdiction of the High Court of South Africa.

• Representing vessel owners in applications to set aside arrests based on the South African admiralty provisions.

• Representing the  port authorities in the course of advancing and defending claims  against and from vessel owners, charterers and port operators.

• Arresting or threatening  to arrest maritime property on behalf of cargo interests and their insurers and negotiating the release of the maritime property in exchange for sufficient security.

• Representing port operators in negotiations with the port authorities and appeals of decisions to the Ports regulators.

• Advising insurers on appropriate policy responses for perishable cargoes and frozen foods claims under the Institute Clauses.

• Drafting of rail interface agreements between private rail operators and municipal road authorities.

• Advising insurers,  shipping lines, road hauliers and brokers on multimodal transport claims.

• Extensive involvement in the reviews of freight forwarders, marine cargo and stock throughout polices for leading insurers in South Africa.

• Representing freight and clearing agents in recovery actions against importers of cargo.

• Representing cargo interests advancing claims against leading warehouses in South Africa.

• Representing leading shipping lines in pursuing recoveries for detention and demurrage claims against their clients in South Africa and Botswana.

• Advising renewable energy companies on the applicable environmental and marine regulatory framework for the establishment of offshore windfarms.

• Assisting in the drafting of the nominated dry port of Togo’s standard terms of trading.
