Both local and international insurers have appointed Lucinda as their lawyer of choice to handle catastrophic claims including the seminal decision of the High Court on causation in Adeels Palace v Moubarak. The decision is the leading authority on causation across all lines of business. Lucinda focused the evidence on the issue of causation from the outset of her retainer.

As an accredited specialist in personal injury, Lucinda's experience extends to providing coverage, defence, strategic and commercial advice, and preparing and conducting criminal and civil litigation. Lucinda’s expertise extends across sexual abuse claims and matters within the disability sector.

Lucinda has significant expertise in providing advice on claims involving defective products and product recall, with a particular focus on medical device product liability and mass tort litigation. At all times, Lucinda's focus is to endeavour to resolve claims at the earliest possible time. Where claims can't be resolved, Lucinda's strategy is to ensure that the best protection is obtained.

Lucinda was recognised in Doyles Guide 2022 NSW rankings as one of only two pre-eminent lawyers in Public & Product Liability and is recommended by Legal 500 for Insurance.

Contingency Cases

  • Acting on behalf of a London Underwriter in responding to various claims made by a production company under a Product Specific Film and Entertainment Policy for losses arising from COVID-19 restrictions to borders, shooting location and mandatory isolation following infection.
     
  • Acting on behalf of a Japanese insurer in respond to a international BI claim made by a hotel chain for COVID-19 related losses (arising from closures and reduced occupancy) at 10 locations throughout Australia.


​Disability Cases

  • Acting, and appearing, on behalf of one of the largest disability care providers in Australia before the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability. The client was the subject of a week-long Hearing that examined incidents related to fatalities in care, abuse of clients by employees, institutional growth and organisational structure.
     
  • Acting on behalf of the largest disability care provider in Australia in response to a claim brought on behalf of a disabled client and their family (five claimants in total) arising from allegations of gross negligence in the provision of care, misappropriation of NDIS funding and institutional neglect in complaints handling.
     

Sexual Abuse Cases 

  • Acting on behalf of a large religious institution (including all relevant subsidiary organisations) in responding to all claims of historical sexual abuse occurring within the relevant State.
     
  • Acting on behalf of the national governing body of a peak Australian sport in responding to all claims arising from historical sexual abuse (including claims brought by way of the National Redress Scheme).
