Kenna Clarke is a dual-qualified solicitor (England & Wales) and attorney-at-law (New York and New Jersey) with a broad range of contentious and regulatory experience.
 
Working with colleagues in the firm’s US offices, Kenna regularly advises clients in relation to regulatory issues which impact the maritime industry, with a specific focus on shipping legislation and regulations, economic sanctions, and competition law. Kenna supports clients in meeting compliance obligations by providing training in these areas, as well as in responding to government investigations and managing the significant discovery-related projects inherent to those investigations. She also actively advises in relation to shipping charges disputes. 
 
Kenna also assists clients with shipbuilding and other commercial disputes under a variety of arbitration regimes and forums, including LMAA, LCIA, SIAC, and ICC. Kenna has experience of High Court proceedings in London, arbitrations in London and Singapore,  federal and state court proceedings in the US, and cross-border insolvency proceedings.
 
Previously, Kenna worked in the firm’s Singapore office and began her career as a litigator in the US. The geographic breadth of her experience lends to the agility with which she approaches the complex, multijurisdictional issues important to clients.

Recent Representative Matters

  • Frequently advises maritime industry client in relation to US shipping legislation, and regulations and rules promulgated by the Federal Maritime Commission.
  • Providing regular advice to maritime clients in relation to sanctions compliance.
  • Counseling maritime clients on Section 301 actions implemented by the US Trade Representative.
  • Advising energy sector clients in relation to export control regulations.
  • Worked as part of a team representing an overseas company and its US affiliates in Department of Justice antitrust investigations. The investigations were closed with no adverse action taken against the client.
  • Participated as an integral part of a team acting on behalf of a shipyard in multiple shipbuilding disputes before the LMAA.
