Michael joined Clyde & Co in 2016 as a trainee solicitor in the Hong Kong office. During his training, Michael has gained a wide range of experience in professional indemnity litigation, corporate insurance and regulatory matters. He was also seconded to London and Guildford acting for marine insurers in handling marine cargo casualty, including vessel collision and cargo recovery claims.
After qualifying in 2018, Michael has been advising clients on dawn raids (including strategies for dawn raids happening at different locations at the same time) and investigations conducted by Insurance Authority, ICAC and police.
Michael also acts for insurers in life insurance, employees' compensation, personal injury, motor, public liability, water seepage and medical negligence claims. He has experience in advising high profile and complex aviation casualty claims. He advises insurers in both contentious and non-contentious policy coverage and interpretation, including policy validity, safety belt clauses, double insurance, under-insurance, late notification, misrepresentation, material non-disclosure and repudiation of policy liability due to other policy breaches.
Furthermore, Michael acts for contractors in industrial summonses relating to health and safety.
Expérience
- Dawn raids – advising clients on search warrants, strategies and practical considerations arising from a dawn raid.
- Regulatory investigations – advising and accompanying clients in Insurance Authority, ICAC and police interviews.
- Insurance policy – Advising insurers on safety belt clauses, double insurance, under-insurance, late notification, misrepresentation, material non-disclosure and repudiation of policy liability due to other policy breaches. Successfully sought contribution from the insureds and co-insurers.
- Insurance policy – Advising insurers on policy coverage in life insurance, including policy validity and false declaration.
- Insurance claims – Advising insurers on contribution proceedings against co-defendants in personal injury, motor and public liability claims. Successfully sought contribution regarding claim and costs from co-defendants.
- Labour summonses – Acting for contractor in defending various industrial summonses brought by the Labour Department. Successfully persuaded prosecution to drop all charges.
- Legal safety training – Providing training to bus inspectors of a leading major bus company.
- Costs – Successfully dismissed the third party action and sought costs against the defendant where the accident was fake (Cheung Yuen Lan v Roth & Sons Estates Management Ltd & Rich Mark Engineering Ltd DCPI 1304/2015, 841/2016).
- Dismissal of EC case – Successfully dismissed EC case due to non-compliance of Court order (Rai Kamaljang v Safeworks Construction Ltd & others DCPI 954/2023)
- Dismissal of PI case – Successfully dismissed PI case and obtained cost order against the Plaintiff on an indemnity basis, though liability was admitted (Sunwar Navin Kumar v Gurkhas Construction Ltd HCPI 59/2020)
