Rose advises insurers on cyber risks, data protection and privacy issues and is recognised by clients as an expert in the cyber market. Rose has experience managing and assisting clients on a range of high profile and multi-jurisdictional cyber incidents including advising on international regulatory issues, litigation risks and international data protection obligations. Rose’s experience advising clients in a variety of sectors means that her advice is both technical and commercially astute.  Rose also supports clients in a variety of sectors to improve their cyber resilience through a range of pre-breach and post-breach services, whilst partnering with technical experts where required. She is also actively involved with developing innovative cyber products for her clients.

In addition to this, Rose advises insurers on cyber coverage issues, policy drafting and wording reviews. Due to Rose’s experience and expertise, she is regularly asked to speak on technical matters at events in the cyber market. 

Rose also has extensive experience representing insurers and reinsurers in complex international arbitrations and litigation across multiple jurisdictions. She has advised on high-value and complex coverage matters with a particular focus on the Bermuda Form (usually involving New York substantive law and English arbitration procedure). Rose acts on behalf of clients on disputes involving catastrophic environmental incidents, product liability and excess liability claims. Rose has been involved in court proceedings in several jurisdictions including the UK, Bermuda, and Australia. 

Rose is dual qualified in England and Wales, and Australia. She was also previously a Legal Consultant in The Hague to an intergovernmental organization on private international law issues and the development of a multilateral instrument on choice of law in international commercial contracts.

Expérience
  • Advising a range of clients on cyber breach incidents both in the UK and on a multi-jurisdictional basis in relation to legal (including the legality or ransomware payments), regulatory (including reporting to regulators within strict timeframes), and litigation issues with a commercial and effective approach
  • Advising a US client in regulatory enforcement action proceedings and appeals with respect to a GDPR fine 
  • Advising on data privacy risks and compliance issues including under the GDPR (e.g. DSARs)
  • Advising insurers and reinsurance on cyber insurance and policy wording issues including war exclusions and the insurability of GDPR fines
  • Acting for liability insurers in relation to claims arising from the explosion of an offshore oil drilling rig in the Gulf of Mexico
  • Acting for a reinsurer in relation to a product liability claim causing personal injury resulting in large scale US litigation
  • Acting for an insurer in successful UK Supreme Court proceedings in relation to the dispute regarding the appointment of an arbitrator
